1. <br />.~ <br />ORDINANCE NO. 95-24 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />ESTABLISHING A "SEWER RELIEF FUND" <br />WHEREAS, many of the Village residents are facing, or will face in <br />the future, a significant financial impact as a result of the necessity <br />created by state and federal environmental protection laws to install <br />and/or improve sanitary sewer systems throughout the Village; <br />WHEREAS, it is the desire of the Village to establish a fund into <br />which will be deposited, as and for the purpose of assisting those <br />citizens throughout the Village facing such mandatory sewer <br />improvements. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That there is hereby and herein established a "Sewer <br />Relief Fund" within the Village of Mayfield. Such a fund shall have <br />funds appropriated into it as determined by Council. Such fund shall <br />be exclusively used for the benefit of the property owners in the <br />Village of Mayfield who are incurring the financial burden of sanitary <br />sewer construction and improvements. <br />SECTION 2. The Village will and does hereby authorize the <br />transfer of $100,000 this fiscal year into the "Sewer Relief Fund" from <br />the General Fund. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance have <br />been taken at open meetings of this Council; and that deliberations of <br />this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of <br />the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the <br />residents of Mayfield Village, Ohio, and for the further reasons set <br />forth in the preamble hereof. It shall, therefore, take effect <br />immediately upon the passage by the affirmative vote of not less than <br />five (5) members elected to Council and approval by the Mayor or <br />otherwise at the earliest time allowed by law. <br />MARK FIXLER, <br />Council President <br />(3) <br />
