ORDINANCE NO. 95-26 (as amended) <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER <br />INTO A CONTRACT WITH CHUCK PRICE'S BURTON FORD WITHOUT <br />THE NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING FOR AN <br />AMOUNT NOT TO EXCEED FIFTY FIVE THOUSAND FIVE HUNDRED <br />DOLLARS ($55,500.00). <br />WHEREAS, Council had previously authorized the purchase of <br />three police cars through the State Purchasing Program, and the <br />orders were submitted, only to find out some time later that the <br />manufacturer could not meet the Statewide demand; and <br />WHEREAS, the police vehicles are deteriorated and in need of <br />immediate replacement; and <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides <br />that in the case of a real and present emergency arising in <br />connection with the maintenance and operation of any municipal <br />department, the legislative authority may, by two-thirds (2/3) vote <br />of all its members elected thereto, authorize the Mayor to enter <br />into a contract for the immediate improvement of public property <br />without formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />purchase three new police cars in the Village of Mayfield without <br />the necessity of formal advertisement and bidding; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of <br />the Village to enter into a contract for three new police cars <br />without the necessity of legal advertisement and formal bidding, in <br />order to immediately protect the Village and to prevent a threat to <br />the health, safety and welfare of the Village residents, which will <br />occur if same are not immediately purchased. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into a contract for the emergency purchase of <br />three 1995 White Crown Victoria police cars from Chuck Price's <br />Burton Ford pursuant to the quote which is attached hereto and <br />incorporated herein as Exhibit "A". The Mayor is authorized to <br />enter into such an agreement without advertising and formal bidding <br />and that the same is necessitated by a real and .present emergency. <br />SECTION 2. Said purchase of the new police cars is hereby <br />authorized for an amount not to exceed Fifty Five Thousand Five <br />Hundred Dollars ($55,500.00) and that the Director of Finance is <br />hereby authorized and directed to make such payment out of the <br />appropriate fund of the Village. <br />
