ORDINANCE NO. 95-58 <br />INTRODUCED BY: Council as a Whole <br />AN ORDINANCE <br />PROPOSING AN AMENDMENT TO ARTICLE III, SECTION 4 OF THE CHARTER <br />OF HAYFIELD VILLAGE PERTAINING TO COUNCIL QUALIFICATIONS <br />WHEREAS, Article XI of the Village Charter provides for a <br />Charter Review Commission every five years; and <br />WHEREAS, the Charter Review Commission has recommended to <br />Council the amendment as hereinafter stated. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Article III, Section 4 of the Charter of the <br />Village of Mayfield, is hereby and herein amended to read as <br />follows: <br />ARTICLE III <br />THE COUNCIL <br /> <br />SECTION 4. QUALIFICATIONS <br />Each member of Council shall have physically resided <br />and been a qualified elector of the Municipality for at <br />least t~i~ee--{3~- two (2~, continuous years immediately <br />prior to his election or appointment, and shall continue <br />to physically reside_ and be a qualified elector <br />throughout his term of office. A member of Council shall <br />not hold any other elected public office or other <br />employment with Mayfield Village, but may be a notary <br />public, a member of the State militia or reserve corp of <br />the United States, unless otherwise prohibited by this <br />Charter. Any member of Council who shall cease to <br />possess any of the qualifications enumerated herein shall <br />forfeit his office, but failure to maintain such <br />qualifications shall not render void or ineffective any <br />action of the Council in which such member has <br />participated.. In addition to the foregoing <br />qualifications, no person shall be eligible to serve as <br />a member of Council from a ward unless such person has, <br />for at least one (1) continuous year immediately prior to <br />either his election or appointment, physically resided in <br />the ward to be represented and during such term of office <br />shall continue to physically reside in that same ward. <br />* ~ ~ <br />SECTION 2. This ordinance, upon adoption by Council, shall be <br />referred by the Clerk to the Cuyahoga County Board of Elections for <br />placement on the ballot in November, 1995.
