ORDINANCE NO. 95-68 INTRODUCED BY: MAYOR RINKER AND COUNCIL AS A WHOLE. AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF CERTAIN PROPERTIES IN HAYFIELD VILLAGE BY CONSTRUCTING SANITARY SEWERS, TOGETHER WITH SERVICE CONNECTIONS THEREFOR AND THE NECESSARY APPURTENANCES THERETO, IN WORTON PARK DRIVE, NORTH WOODLANE DRIVE, WOODLANE DRIVE, SOUTH WOODLANE DRIVE AND NORMAN LANE, BETWEEN CERTAIN TERMINI, AND DECLARING AN EMERGENCY. WHEREAS, this Council has adopted Resolution No. 95-28 on June 19, 1995, declaring the necessity of making the improvement described in Section 1; and WHEREAS, this Council has adopted Resolution No. 95- 34 on August 2&:, 1995, approving the report of the Assessment Equalization Board, appointed by Resolution No. 95-30, adopted August 9, 1995; NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, Cuyahoga County, Ohio, that: Section 1. It is determined to proceed with the improvement of the properties described in Section 4 of Resolution No. 95-28, adopted on June 19, 1995, by constructing sanitary sewers, together with service connections therefor and the necessary appurtenances thereto, in Worton Park Drive from an existing sanitary sewer in Wilson Mills Road to South Woodlane Drive, in North Woodlane Drive from Worton Park Drive to Woodlane Drive, in Woodlane Drive from North Woodlane Drive to South Woodlane Drive, in South Woodlane Drive from Woodlane Drive easterly approximately 715 feet and from a point approximately 165 feet westerly of Worton Park Drive easterly approximately 355 feet to the terminus of South Woodlane Drive and in Norman Lane from Worton Park Drive to a point approximately 130 feet easterly of Woodlane Drive. Section 2. The improvement shall be made in accordance with the provisions of Resolution No. 95-28, and with the plans, specifications, profiles and estimate of cost previously approved and now on file in the office of the Clerk of Council. Section 3. All claims for damages resulting from the improvement that have been legally filed shall be inquired into after completion of the improvement, and the Law Director is authorized and directed to institute legal proceedings in a court of competent jurisdiction to inquire into those claims. Section 4. The portion of the cost of the improvement to be assessed in accordance with Resolution No. 95-28, shall be assessed in the manner and pursuant to the payment schedule set forth, and on the lots and lands described, in that resolution.
