ORDINANCE NO. 95-68 <br />INTRODUCED BY: MAYOR RINKER AND COUNCIL AS A WHOLE. <br />AN ORDINANCE DETERMINING TO PROCEED WITH THE <br />IMPROVEMENT OF CERTAIN PROPERTIES IN HAYFIELD <br />VILLAGE BY CONSTRUCTING SANITARY SEWERS, TOGETHER <br />WITH SERVICE CONNECTIONS THEREFOR AND THE <br />NECESSARY APPURTENANCES THERETO, IN WORTON PARK <br />DRIVE, NORTH WOODLANE DRIVE, WOODLANE DRIVE, <br />SOUTH WOODLANE DRIVE AND NORMAN LANE, BETWEEN <br />CERTAIN TERMINI, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has adopted Resolution No. 95-28 on June 19, 1995, <br />declaring the necessity of making the improvement described in Section 1; and <br />WHEREAS, this Council has adopted Resolution No. 95- 34 on August 2&:, 1995, <br />approving the report of the Assessment Equalization Board, appointed by Resolution No. 95-30, <br />adopted August 9, 1995; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, <br />Cuyahoga County, Ohio, that: <br />Section 1. It is determined to proceed with the improvement of the properties <br />described in Section 4 of Resolution No. 95-28, adopted on June 19, 1995, by constructing <br />sanitary sewers, together with service connections therefor and the necessary appurtenances <br />thereto, in Worton Park Drive from an existing sanitary sewer in Wilson Mills Road to South <br />Woodlane Drive, in North Woodlane Drive from Worton Park Drive to Woodlane Drive, in <br />Woodlane Drive from North Woodlane Drive to South Woodlane Drive, in South Woodlane <br />Drive from Woodlane Drive easterly approximately 715 feet and from a point approximately <br />165 feet westerly of Worton Park Drive easterly approximately 355 feet to the terminus of <br />South Woodlane Drive and in Norman Lane from Worton Park Drive to a point approximately <br />130 feet easterly of Woodlane Drive. <br />Section 2. The improvement shall be made in accordance with the provisions of <br />Resolution No. 95-28, and with the plans, specifications, profiles and estimate of cost previously <br />approved and now on file in the office of the Clerk of Council. <br />Section 3. All claims for damages resulting from the improvement that have been <br />legally filed shall be inquired into after completion of the improvement, and the Law Director <br />is authorized and directed to institute legal proceedings in a court of competent jurisdiction to <br />inquire into those claims. <br />Section 4. The portion of the cost of the improvement to be assessed in accordance <br />with Resolution No. 95-28, shall be assessed in the manner and pursuant to the payment <br />schedule set forth, and on the lots and lands described, in that resolution. <br />
