RESOLUTION NO. 94-10 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING AND DIRECTING THE VILLAGE <br />ENGINEER TO PREPARE PLANS AND SPECIFICATIONS <br />WITH REGARDS TO THE UPPER 40 DRAINAGE IMPROVEMENT PROJECT <br />WHEREAS, it is the desire of Council to authorize the Village <br />Engineer to prepare plans and specifications for the Upper 40 <br />drainage improvement project; and <br />WHEREAS, the Village Council deems this Resolution to be in <br />the best interest of the health, safety and welfare of all of the <br />Village residentso <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Village Engineer is hereby and herein <br />authorized and directed to prepare plans and specifications for the <br />Upper 40 drainage improvement project which will consist of three <br />components, which are set forth as follows: <br />1. The repair and partial replacement of an existing <br />storm sewer system. <br />2. The cleaning of sediment and removal thereof and the <br />reconstruction of an outlet structure in an existing <br />pond. <br />3. The construction of a detention basin in a area to be <br />located in and upon the area known as the Upper 40 area. <br />SECTION 2. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />?`?"`L <br />J E CINCO, <br />-ncil President
