RESOLUTION NO. 94-18 (as amended) INTRODUCED BY: Mayor Rinker and Council as a Whole A RESOLUTION AUTHORIZING AN OCCUPANCY AT 761 BETA DRIVE FOR HILLMED HOME MEDICAL SYSTEMS WHEREAS, under Article V, Section 12.1, the Council is the exclusive body to determine variances and uses within the commercial districts of the Village; and WHEREAS, Hillmed Home Medical Systems currently located at 761 Beta Drive, has applied for an additional occupancy of a small portion of their property for a"dialysis business center"; and WHEREAS, the applicant has verified in writing and to the Council that there will be no medical treatment of patients, that no physician's offices will be maintained, and that the proposed use is ancillary to the medical supply business currently permitted and occupying the balance of the space at the premises; and WHEREAS, based upon the above statements and guarantees, it is the conclusion of Council that the proposed use is a permitted office space use in the Production/Distribution District within which the property is located. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the proposed occupancy of Hillmed Home Medical Systems for a"dialysis business center" in 500 square feet at 761 Beta Drive, is hereby and herein approved with the condition that no treatment of patients will take place upon the premises, no improper handling of controlled wastes under State or Federal law will occur on the premises, and that no medical doctor's offices will be maintained on the premises. SECTION 2. This Resolution shall become effective upon its adoption by Council and by signature of the Mayor or as may otherwise be provided for by law. NE CINCO, ?
