RESOLUTION NO. 94-47 INTRODUCED BY: Mayor Rinker and Council as a Whole A RESOLUTION OPPOSING UNFUNDED MANDATES IMPOSED BY THE FEDERAL GOVERNMENT AND DECLARING AN EMERGENCY WHEREAS, unfunded federal mandates on state and local governments have become increasingly extensive in recent years; WHEREAS, such mandates have, in many instances, added to growing deficits in state and local budgets and have resulted in the need for local governments to increase revenue of curtail services; WHEREAS, such excessive fiscal burdens on local governments have undermined, in many instances, the ability of local governments to achieve their responsibility under state and local law. In the Village of Mayfield, these mandates pose an unusually excessive financial burden, WHEREAS, HR 140, the Federal Mandate Relief Act of 1993, would assure that the federal government pays the total amount of direct cost incurred by state and local governments in complying with certain requirements which take effect on or after the date with of enactment of the Act under a federal stature or regulation; and WHEREAS, this legislation would provide that any requirement under a federal stature or regulation that a state or local government conduct an activity (including a requirement that a government meet national standards in providing a service) shall apply to the local government only if all funds necessary to pay the direct cost incurred by the municipal government in conducting the activity are provided by the federal government. fdOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Mayfield: SECTION 1. That the Council of the Village of Mayfield supports HR 140 and goes on record as endorsing this bill. SECTION 2. That the Clerk of Council be and she is hereby instructed to forward copies of this Resolution to Senator John Glenn; Senator Howard Metzenbaum; Representative Louis Stokes; State Senator Jeff Johnson; House Representative Barbara Boyd; and House Speaker Vernal Riffe, Jr., and all Cuyahoga County iVlunicipalities. SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. That this Resolution is hereby declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.
