RESOLUTION NO. 94-47 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />A RESOLUTION OPPOSING <br />UNFUNDED MANDATES IMPOSED BY THE <br />FEDERAL GOVERNMENT AND DECLARING AN EMERGENCY <br />WHEREAS, unfunded federal mandates on state and local governments have <br />become increasingly extensive in recent years; <br />WHEREAS, such mandates have, in many instances, added to growing deficits in <br />state and local budgets and have resulted in the need for local governments to increase <br />revenue of curtail services; <br />WHEREAS, such excessive fiscal burdens on local governments have undermined, <br />in many instances, the ability of local governments to achieve their responsibility under state <br />and local law. In the Village of Mayfield, these mandates pose an unusually excessive <br />financial burden, <br />WHEREAS, HR 140, the Federal Mandate Relief Act of 1993, would assure that the <br />federal government pays the total amount of direct cost incurred by state and local <br />governments in complying with certain requirements which take effect on or after the date with <br />of enactment of the Act under a federal stature or regulation; and <br />WHEREAS, this legislation would provide that any requirement under a federal <br />stature or regulation that a state or local government conduct an activity (including a <br />requirement that a government meet national standards in providing a service) shall apply to <br />the local government only if all funds necessary to pay the direct cost incurred by the <br />municipal government in conducting the activity are provided by the federal government. <br />fdOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Mayfield: <br />SECTION 1. That the Council of the Village of Mayfield supports HR 140 and <br />goes on record as endorsing this bill. <br />SECTION 2. That the Clerk of Council be and she is hereby instructed to <br />forward copies of this Resolution to Senator John Glenn; Senator Howard Metzenbaum; <br />Representative Louis Stokes; State Senator Jeff Johnson; House Representative Barbara <br />Boyd; and House Speaker Vernal Riffe, Jr., and all Cuyahoga County iVlunicipalities. <br />SECTION 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Resolution were adopted in an open meeting of <br />this Council, and that all such deliberations of this Council and of any of its committees that <br />resulted in such formal action were in meetings open to the public in compliance with all legal <br />requirements. <br />SECTION 4. That this Resolution is hereby declared to be an emergency <br />measure and, provided it receives the affirmative vote of two-thirds of all the members elected <br />to Council, it shall take effect and be in force immediately upon its passage and approval by <br />the Mayor; otherwise it shall take effect and be in force from and after the earliest period <br />allowed by law.
