ORDINANCE NO. 94-15 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN IIMERGENCY ORDINANCE <br />APPROVING FEES PROPOSED TO BE LEVIED BY THE SOLID <br />WASTE MANAGIIMENT POLICY COMMITTEE OF THE CUYAHOGA <br />COUNTY SOLID WASTE MANAGIIMENT DI5TRICT ON THE <br />GENERATION OF SOLID WASTES WITHIN THE DISTRICT <br />WHEREAS, the Ohio Waste Disposal Act, effective June 24, 1988, <br />mandated that all counties establish a Solid Waste District and a Solid <br />Waste Management Policy Committee to prepare, adopt and submit to the <br />Ohio Environmental Protection Agency a Solid Waste Management Plan <br />(Sections 3734.52, Ohio Revised Code); and <br />WHEREAS, through its Resolution No. 814313, adopted August 29, <br />1988, the Cuyahoga County Board of Commissioners formed a single-county <br />Solid Waste Management District, in accordance with Section 3734.52 of <br />the Ohio Revised Code; and <br />TnhEREAS, the Director of the Ohio Environmental Protection Acency, <br />on March 30, 1989, designated the Cuyahoca County Planning Commission <br />to serve as the Solid Waste Management Policy Committee for the Cuyahoga <br />County Solid Waste District (the "Policy Committee") pursuant to Section <br />3734.54(D) of the Ohio Revised Code; and <br />WBEREAS, the Policy Committee is authorized by Divisions (A) and <br />(B) of Section 3734.573 of the Revised Code to levy fees upon the <br />generation of solid wastes within the District for the purpose of <br />preparing, revising-and implementing the Plan and as otherwise provided <br />in Section 3734.573 of the Revised Code; and <br />WHEREAS, the Policy Committee has adopted and submitted to the <br />Council a resolution adopting a proposed fee schedule upon the <br />generation of solid wastes within the District and disposed of within <br />the State of Ohio; and <br />WHEREAS, the Village of Mayfield is required by Division (B) of <br />Section 3734.55 of the.Revised Code to approve or disapprove the <br />proposed fees and has been requested to approve those fees. <br />NOW, 'I'HEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION l. The proposed rate of fees of One Dollar ($1.00) per ton <br />(three cubic yards shall compromise one ton) adopted by the Policy <br />Committee to be levied under Divisions (A) and (B) of Section 3734.573 <br />of the Revised Code upon the generation of solid wastes within the <br />District and disposed of within the State of Ohio are hereby approved. <br />SECTION 2. The Clerk of Council is hereby authorized and directed <br />to mail or otherwise deliver promptly a certified copy of this <br />Resolution to the Policy Committee. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance have <br />been taken at open meetings of this Council; and that deliberations of <br />this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of <br />the Ohio Revised Code. <br />?
