,- ORDINANCE NO. 94-21 (as amended) <br />INTRODUCED BY: Mayor Rinker and,Council as a Who1e <br />AN EMERGENCY ORDINANCE AMENDING SECTION 505.15 OF THE CODIFIED ORDINANCES <br />PERTAINING TO ANIMALS AIdD <br />THE KEEPING OF SAME NEAR DWELLINGS <br />WHEREAS, the Building Commissioner has recommended a change to <br />Section 505.15 of the Codified Ordinances to limit the number of <br />animals on each premise and to control the location of animals on <br />properties near dwellings and to control the disposal of wastes <br />from barns or sheds that may house such animals; and <br />WHEREAS, it is the intention of Council to adopt this <br />amendment. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 505.15 of the Codified Ordinances is <br />hereby and herein amended to read as follows: <br />505.15 KEEP ANIMALS NEAR DWELLINGS. <br />(a) No person shall raise, harbor or keep any domestic animal <br />within the Village so as to cause a nuisance condition as described <br />in Section 505.16. <br />(b) No person shall keep, harbor or maintain any horses, <br />mules, cattle or any animal other than a domestic animal on his <br />property if such property is less than two acres. If the property <br />is two acres or larger then, in order to maintain such animals, the <br />owner shall construct on the premises, a corral or enclosure for <br />such animals which shall be at least ten feet from any property <br />line and at least two hundred feet from the dwelling, other main <br />building on the premises or any dwelling on any adjacent property. <br />The owner shall furthermore construct a barn or shed to house <br />such animals which barn or shed shall be totally within the corral <br />or enclosure referred to herein above. The floor of such barn or <br />shed shall include channeling to dispose of animal urine by <br />underground piping to an approved sanitary sewer or other approved <br />sanitary disposal facility approved by the Board of Health of <br />Cuyahoga County. The owner shall furthermore be responsible for <br />bagging and disposing of all manure on a daily basis. <br />(c) There shall be provided a minimum grazing area of one (1) <br />acre for a horse, mule or cattle plus an additional ten thousand <br />(10,000) square feet of grazing for each additional such animal. <br />SECTION 2. That the existing Section 505.15 as adopted by <br />Ordinance No. 84-11 on October 15, 1984, is hereby and herein <br />repealed. <br />(3)
