ORDINANCE NO. 94-30 (as amended) <br />INTRODUCED BY: Councilman Fixler and Busa <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING A MODIFICATION TO <br />THE CONTRACT, AND ADDITIONAL SUMS OF MONEY, <br />WITH REFERENCE TO THE HIGHLAND-SOM INTERSECTION IMPROVEMENTS <br />WHEREAS, A&J Cement Contractors, Inc. has estimated an <br />additional Fifteen Thousand Dollars ($15,000.00) of additional <br />construction costs to provide continuous access to Highland Road, <br />going westbound, during the Highland-SOM intersection improvements; <br />and <br />WHEREAS, the Engineer and Police Chief have advised that <br />additional costs will be necessary for police manning, traffic <br />control, and safety precautions that will be necessitated by such <br />a change in the contract. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION l. That the Mayor, Director of Finance, and Village <br />Engineer, are hereby and herein authorized and directed to cause an <br />amendment to the existing contract for the Highland-SOM <br />intersection improvement, to the extent that same will permit <br />traffic exiting from Wildwood to have continuous access to go <br />westbound on Highland Road during the entire construction period. <br />The contract for construction shall be amended to authorize an <br />additional sum of money, not to exceed Fifteen Thousand Dollars <br />($15,000.00), for such modifications and construction. <br />SECTION 2. The Mayor is hereby and herein authorized and <br />directed to authorize additional police manpower, through overtime, <br />or outside sources, to provide whatever manpower is necessary in <br />the opinion of the Chief of Police, and the Engineer, to assist in <br />preserving safety and traffic control throughout the construction <br />project necessitated by the aforementioned modifications. <br />SECTION 3. The Mayor is further authorized and directed to <br />contract for any additional safety barriers, signage, or other <br />costs not previously approved for traffic control and safety <br />preservation throughout the construction project as will be <br />necessitated by these modifications. <br />SECTION 4. In as much the Village's budget for 1994 did not <br />anticipate these additional costs, the Finance Director is <br />authorized to prepare an amended appropriation ordinance as will be <br />necessitated by additional costs in each of the Departments <br />referred to above. <br />SECTION 5. The Council finds and determines that all formal <br />actions of this Council relating to tlie adoption of this Ordinance <br />have been taken at open meetings of this Council; and that
