To answer your questions contained in the
minutes, I am hereby providing this opinion.
Article III, Section 13, Subparagraph (d), does require that
any restrictions on the height of any buildings or structures is a
subject matter which must be handled formally, by referral to
Planning and Zoning, public hearing, and legal notices.
Furthermore, the Charter requires that an amendment of this nature
be voted upon by the electors.
Also, in reviewing the Codified Ordinances, I believe that
amendments need to take place at three different sections of the
. Code relative to height limitations. I have drafted the ordinan'cE*.
,--?
to amend Sections 1157.06, 1181.01 and 1181.07. If there 15
something undesirable about the manner in which I have drafted
this, please let me know. If it meets with your approval, please
let me know and I will have it forwarded to Council for
consideration and referral to the Planning and Zoning Commission.
Thank you for your attention
to these matters.
,-?l
Very truly,yours,
Joseph W.
