*Failed 6/20/94 <br />ORDINANCE NO. 94-36 ' <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN IIMERGENCY ORDINANCE <br />AUTHORIZING THE PURCHASE OF AN ONE AND ONE-HALF TON <br />INTERNATIONAL DUMP TRUCK FROM JONES EQUIPMENT . <br />WHEREAS, the Service Department of the Village of Mayfield has been <br />presented with a real and present emergency by the loss of certain <br />vehicles necessary for the daily operation of the Department; and <br />WHERFAS, to postpone the purchase of the needed dump truck for the <br />time period necessary for public bidding will cause a real threat to the <br />health, safety and welfare of residents in this community; and <br />WFIEREAS, Jones Equipment has an one and one-half ton International <br />dump truck available, and is willing to pay to the Village Fourteen <br />Thousand Five Hundred Dollars ($14,500.00) as and for the trade-in of <br />an existing truck no longer suitable or capable of ineeting the needs of <br />the Village of Mayfield; and <br />WHEREAS, it is the desire of Council to authorize the purchase of <br />the Jones Equipment one and one-half ton International dump truck <br />pursuant to certain specifications of the Service Director, for a <br />purchase price of Forty-Eight Thousand Dollars ($48,000.00), less a <br />trade in of Fourteen Thousand Five Hundred Dollars ($14,500.00) for a <br />total payment to Jones Equipment of Thirty-Three Thousand Five Hundred <br />Dollars ($33,500.00); and <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides that <br />in the case of a real and present emergency arising in connection with <br />the maintenance and operation of any municipal department, the <br />legislative authority may, by two-thirds (2/3) vote of all its members <br />elected thereto, authorize the Mayor to enter into a contract without <br />formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />purchase the dump truck for the continuing operation of the Service <br />Department in the Village of Mayfield without the necessity of formal <br />bidding and advertising; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of the <br />Village to enter into a contract for the dump truck without the <br />necessity of legal advertisement and formal bidding, in order to <br />immediately protect the Village and to prevent a threat to the health, <br />safety and welfare of the Village residents, which will occur if there <br />is a delay in the awarding of this contract. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILIAGE, <br />OHIO, THAT: <br />SECTION 1: That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with Jones Equipment as and for the <br />purchase of a one and one-half ton International Dump Truck, and to <br />trade in an existing Village vehicle for a net-purchase price of Thirty- <br />Three Thousand Five Hundred Dollars ($33,500.00). The Mayor is <br />authorized to enter into such an agreement without advertising and <br />formal bidding and that the same is necessitated by a real and present <br />emergency.
