ORDINANCE NO. 94-39 <br />• INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE PURCHASE OF A ROTO GRIND TUB GRINDER <br />AND A ONE HUNDRED SEVENTY-FIVE HORSE POWER DIESEL <br />WITHOUT 'I'HE NECESSITY OF PUBLIC BIDDING FOR THE SUM <br />OF THIRTY-SIX THOUSAND DOT,LARS <br />WHEREAS, the Village is in i.mmediate need for the operation of the <br />Service Department, and to handle the debris and stock piling of certain <br />items to be eliminated, and in order to save the taxpayers considerable <br />dollars before the summer months expire, to purchase a Roto Grind Tub <br />Grinder (Pull Tupe PTO Powered), modified to make the Roto Grind totally <br />self contained by reason of being powered by a One Hundred Seventy-Five <br />Horse Power Diesel; and <br />WHEREAS, the purchase price for same is Thirty-Six Thousand Dollars <br />($36,000.00) from Middlefield Farm and Garden located in Middlefield, <br />Ohio, and such items are unique in nature, and impossible for receiving <br />appropriate bids after public advertising. <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides that <br />in the case of a real and present emergency arising in connection with <br />the maintenance and operation of any municipal department, the <br />legislative authority may, by two-thirds (2/3) vote of all its members <br />elected thereto, authorize the Mayor to enter into a contract without <br />formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />purchase the Roto Grind Tub Grinder for the continuing operation of the <br />` Service Department in the Village of Mayfield without the necessity of <br />formal bidding and advertising; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of the <br />Village to enter into a contract for the Roto Grind Tub Grinder without <br />the necessity of legal advertisement and formal bidding, in order to <br />immediately protect the Village and to prevent a threat to the health, <br />safety and welfare of the Village residents, which will occur if there <br />is a delay in the awarding of this contract. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with Middlefield Farm and Garden for <br />the purchase of Roto Grind Tub Grinder (Pull Tupe P'I'O Powered), modified <br />to make the Roto Grind totally self contained by reason of being powered <br />by a One Hundred Seventy-Five Horse Power Diesel, for an amount not to <br />exceed Thirty-Six Thousand Dollars ($36,000.00). The Mayor is <br />authorized to enter into such an agreement without advertising and <br />formal bidding and that the same is necessitated by a real and present <br />emergency. <br />SECTION 2. Said contract is hereby authorized for this amount and <br />the Director of Finance is hereby and herein authorized and directed to <br />make such payment out of the appropriate fund of the Village. <br />? The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance have <br />-., been taken at open meetings of this Council; and that deliberations of
