ORDINANCE NO. 94-Q-0 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />DECLARING THE NECESSITY AND INTENTION TO <br />APPROPRIATE FEE SIMPLE, AND PERMANENT AND <br />TEMPORARY EASEMENT, INTERESTS IN THE PREMISES <br />KNOWN AS PERMANENT PARCEL NUMBERS 831-28-001 AND 831-30-001 <br />FOR CONSTRUCTION AND MAINTEIJANCE OF A WATER DETENTION FACILITY <br />WHEREAS, in promotion of the health, safety and welfare of the <br />residents of the Village of Mayfield, it is necessary for the <br />Village to appropriate fee simple, permanent and temporary easement <br />interests to the premises known as Permanent Parcel Numbers 831-28- <br />001 and 831-30-001, for the construction and maintenance of a water <br />detention facility <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That this Council deems it necessary and declares <br />its intention to appropriate fee simple, permanent and temporary <br />easement interests to the premises known as Permanet Parcel Numbers <br />831-28-001 and 831-30-001, as described in the attached Exhibits <br />"A(1) - A(2)", and 11 B(1) - B(6)", incorporated herein by reference <br />as if fully rewritten, for the construction and maintenance of a <br />water detention facility. <br />SECTION 2. That the. Mayor is herein and hereby authorized and <br />directed to cause written notice of the passage of this resolution <br />to be given to the owners or persons in possession or having an <br />interest of record in the premises; and that said notice shall be <br />served and returned according to law. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />,?LG??x.G ? 1? c.?t' <br />O NE CINCO, ? <br />Co ncil President <br />(z)
