ORDINANCE NO. 94- 47 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR TO ENTER INTO A <br />CONTRACT WITH METRO UTILITY, INC. IN ORDER TO REPAIR <br />CERTAIN VILLAGE SIDEWALKS. <br />WHEREAS, it has already been deemed necessary and in the best <br />interest of the health, safety and welfare of all of the Village <br />residents to perform repairs to various sidewalks throughout the <br />Village; and <br />WHEREAS, pursuant to law, bids were advertised by the Village, <br />those bids were received, and it was determined that the bid of <br />Metro Utility, Inc. was the best bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into a contract with Metro Utility, Inc. to <br />perform repairs to various sidewalks throughout the Village, <br />pursuant to the bids and specifications as advertised by the <br />Village, and pursuant to that company's bid in the amount of <br />Thirteen Thousand Four Hundred Eighty Three Dollars and seventy <br />five cents ($13,483.75), as received by the Village, which is <br />hereby and herein determined to be the best bid, and pursuant to <br />the terms and conditions as set forth in these documents, which <br />shall be maintained by the Director, of Finance. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />?64,-, <br />J E CINCO, <br />o cil President
