.?_ ORDINANCE NO. 94-?;1 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT FOR CONSTRUCTION MANAGEMENT <br />WITH PANZICA CONSTRUCTION COMPANY <br />WHEREAS, the Village in 1991 solicited and reviewed several <br />proposals for the position of construction manager for the future <br />construction of a municipal complex, and/or fire station; and <br />WHEREAS, Council and the administration determined at that <br />time that the best proposal was that of Panzica Construction <br />Company to perform the professional service of construction manager <br />during the time period of any municipal complex or fire station <br />construction; and <br />WHEREAS, Council has again reviewed the contract which has <br />since expired, and have made certain modifications and received a <br />reduction in price and are therefore desirous of renewing this <br />contract for the anticipated construction of the fire station, and <br />the potential future construction of a municipal complex center. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into, an agreement with Panzica Construction <br />- Company as and for construction manager professional services in <br />the form and on the terms set forth in Exhibit "A" attached hereto <br />and incorporated herein by reference. <br />SECTION 2. The Director of Finance is authorized to make <br />payment under the terms of the attached contract out of the <br />appropriate fund established for such purpose by this Council. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />_ allowed by law.
