ORDINANCE NO. 94-52,- INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH THE OSTERLAND CO. WITHOUT THE NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING FOR AN AMOUNT NOT TO EXCEED ELEVEN THOUSAND DOLLARS ($11,000.00) WHEREAS, Section 735.051 of the Ohio Revised Code provides that in the case of a real and present emergency arising in connection with the maintenance and operation of any municipal department, the legislative authority may, by two-thirds (2/3) vote of all its members elected thereto, authorize the Mayor to enter into a contract for the immediate improvement of public property without formal bidding and advertising; and WHEREAS, it has been deemed a real and present emergency to improve Wilson Mills Road, east of S.O.M. Center Road for 290 feet, in the Village of Mayfield without the necessity of formal advertisement and bidding; and WHEREAS, it is the intent of Council to authorize the Mayor of the Village to enter into a contract not to exceed Eleven Thousand Dollars ($11,000.00) without the necessity of legal advertisement and formal bidding, in order to immediately protect the Village and to prevent a threat to the health, safety and welfare of the Village residents, which will occur if the roadway is not immediately repaired. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into a contract for the emergency construction of improvements to Wilson Mills Road for 290 feet east of S.O.M. Center Road with the Osterland Co., pursuant to the quote which is attached hereto and incorporated herein as Exhibit "A". The Mayor is authorized to enter into such an agreement without advertising and formal bidding and that the same is necessitated by a real and present emergency. SECTION 2. Said contract for road repairs is hereby authorized for an amount not to exceed Eleven Thousand Dollars ($11,000.00) and that the Director of Finance is hereby authorized and directed to make such payment out of the appropriate fund of the Village. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
