- ORDINANCE NO. 93-1 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH <br />EMERGENCY ONE, INC. WITHOUT THE NECESSITY OF <br />ADVERTISEMENT AND FORMAL BIDDING FOR AN AMOUNT <br />NOT TO EXCEED THREE HUNDRED NINETY <br />THOUSAND DOLLARS ($390,000.00) PLUS LEASE FINANCING <br />OF SAME OVER A FIVE YEAR~PERIOD <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides <br />that in the case of a real and present emergency arising in <br />connection with the maintenance and operation of any municipal <br />department, the legislative authority may, by two-thirds (2/3) vote <br />of all its members elected thereto, authorize the Mayor to enter <br />into a contract for the immediate improvement of public property <br />without formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />lease/purchase an Emergency One Model 93, GO-70, 75 foot Quint <br />Aerial Fire Apparatus for the Village of Mayfield without the <br />necessity of formal advertisement and bidding; and <br />WHEREAS, the Fire Chief has inspected and received quotes from <br />other fire apparatus manufacturers and has discovered that they are <br />unable to provide a piece of equipment which will fit in the <br />existing structure of the Fire Department, and meet all of the <br />safety and capacity requirements which are needed by the Fire <br />Department, and to manufacture one to meet such capacity would take <br />a minimum of one year after advertising, formal bidding, and the <br />awarding of a contract; and <br />WHEREAS, to go through the formal bidding process will cost <br />the taxpayers of Mayfield Village at least Forty Thousand Dollars <br />($40,000.00) additional, plus a minimum of one year delay in <br />obtaining the equipment which is immediately needed; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of <br />the Village to enter into a contract for said purchase without the <br />necessity of legal advertisement and formal bidding, in order to <br />immediately protect the Village and to prevent a threat to the <br />health, safety and welfare of the Village residents, which will <br />occur if said equipment is not immediately made available. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into a contract for the emergency lease/purchase <br />of a Model 93, GO 70, 75 foot Quint Aerial Fire Apparatus from <br />Emergency One, Inc. pursuant to the contract for leasing of same <br />over a five year period, which is attached hereto and incorporated <br />herein as Exhibit "A".
