*Failed.5/17/93 <br />ORDINANCE NO. 93- 3 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING CHAPTER 1175 OF THE CODIFIED <br />ORDINANCES PERTAINING TO THE PROTECTION OF <br />HILLSIDE DEVELOPMENT <br />WHEREAS, there are certain topographical locations throughout <br />the Village that present unique and potentially dangerous <br />situations in so far as construction of dwellings is concerned; and <br />WHEREAS, stability of construction, erosion of earth material, <br />and downstream protection, are all factors which require the <br />protection of property owners and residents, present and future, <br />through legislation; and <br />WHEREAS, it is the desire of Council to adopt controls and <br />regulations for the protection of the property owners and residents <br />who live on or develop certain hillside property within the <br />Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Chapter 1175 is hereby and herein created to <br />read as set forth in Exhibit A which is attached hereto and <br />incorporated herein by reference. <br />SECTION 2. Any sections of the Codified Ordinances <br />inconsistent with newly created Chapter 1175 are hereby and herein <br />repealed. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble. hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />BRUCE RINKER, <br />Council President <br />
