1 <br />ORDINANCE NO. 93- 17 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING SECTION 139.05 OF THE CODIFIED <br />ORDINANCES RELATING TO LAW ENFORCEMENT <br />TRUST FUND <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 139.05 of the Codified Ordinances is <br />hereby and herein created to read as follows: <br />139.05 LAW ENFORCEMENT TRUST FUND. <br />(a) The Director of Finance is hereby authorized and directed <br />to accept cash, vehicles and other property in accordance with <br />the Contraband Seizure Forfeiture Act, Ohio R.C. 2933.43; <br />except that any acceptance of real estate by the Director of <br />Finance shall be subject to approval by action of Council. <br />(b) The Director of Finance is hereby directed to place all <br />cash received into a Special Law Enforcement Trust Fund to be <br />used solely for the law enforcement purposes set forth in the <br />contraband statute as it now exists, Ohio R.C. 29.33.43(D)(4) <br />or as it may be amended in the future. Such Fund shall be <br />separate and apart from all other special funds. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />~.~.~ ~~. <br />J E CINCO, <br />o cil President <br />
