1 ORDINANCE NO. 93- 17 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE CREATING SECTION 139.05 OF THE CODIFIED ORDINANCES RELATING TO LAW ENFORCEMENT TRUST FUND BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That Section 139.05 of the Codified Ordinances is hereby and herein created to read as follows: 139.05 LAW ENFORCEMENT TRUST FUND. (a) The Director of Finance is hereby authorized and directed to accept cash, vehicles and other property in accordance with the Contraband Seizure Forfeiture Act, Ohio R.C. 2933.43; except that any acceptance of real estate by the Director of Finance shall be subject to approval by action of Council. (b) The Director of Finance is hereby directed to place all cash received into a Special Law Enforcement Trust Fund to be used solely for the law enforcement purposes set forth in the contraband statute as it now exists, Ohio R.C. 29.33.43(D)(4) or as it may be amended in the future. Such Fund shall be separate and apart from all other special funds. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. ~.~.~ ~~.
