<br />CONTRACT <br />r <br />THIS CONTRACT, made and entered into this °~G day of August, <br />1993, by and between the Village of Mayfield, a Municipal <br />Corporation of Cuyahoga County, Ohio, (hereinafter called the <br />"Village") and BFI Waste Systems of Ohio, Inc. (hereinafter called <br />the "Contractor"). <br />W I T N E S E T H: <br />WHEREAS, the Contractor did on the ~~ day of \~'"~, 1993, <br />submit a Proposal to Provide Refuse Collection with n the Village <br />and to perform such work as may be incidental thereto. <br />NOW, THEREFORE, in consideration of the following mutual <br />agreements and covenants, it is understood and agreed by and <br />between the parties hereto as follows: <br />1. The Contractor is hereby granted the sole and <br />exclusive franchise, license and privilege <br />within the territorial jurisdiction of the <br />Village and shall furnish all personnel, <br />labor, equipment, trucks and all other items <br />necessary to provide refuse collection, <br />removal and disposal service as specified; and <br />to perform all of the work called for and <br />described in the Contract Documents, including <br />all solid waste collection and disposal and <br />recyclable collection and processing as well <br />as all yard waste if elected by the Village. <br />The contract shall be for a three (3) year <br />period beginning August 1, 1993 to August 1, <br />1996. The initial three (3) year term of this <br />contract shall automatically be extended for <br />two (2) successive additional one (1) year <br />terms, unless the Village notifies the <br />Contractor in writing not less than one <br />hundred twenty (120) days prior to the <br />expiration of the initial three (3) year term <br />or of any successive one (1) year term, of its <br />intention to terminate this Contract. Any <br />such written notice shall be served by <br />certified or registered mail, return receipt <br />requested. <br />
