7/19/93 ORDINANCE NO. 93-34 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AMENDING SECTION 1157.08(b) RELATING TO PERMITTED FENCES IN RESIDENTIAL DISTRICTS WHEREAS, it is recommended by the Ordinance Review Committee that certain clarifications be set forth in the Codified Ordinances relating to permissible fences in residential districts. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That Section 1157.08(b) of the Codified Ordinances is hereby and herein amended to read as follows: 1157.08 FENCES; PERMIT; FEE. (b) In Side and Rear Yards. In side yards and rear yards i• Class U-1, U-2, U-3AA Use Districts, the only fences permitt~ shall be as follows: Split Rail, Chain Link, Board and Boa((~z..d and Picket fences Board and Board fences are to be built p the horizontal space between the vertical boards is 3 1/2".) Open fences not over four and one-half feet in height shall be permitted along the side yards and along the rear lot line, provided such fences shall have uniformly spaced openings aggregating twenty-five percent of their surface areas between residential properties. However, in open or a closed fence not over eight feet in height may be placed along the rear or side line which separates residential property from property used for non- residential purposes, subject to the written approval of the Building Commissioner, who shall not give his approval if he finds that such proposed fence is unsafe or unsightly or that it obstructs necessary light and air from adjacent property or that in some manner it does not conform with the orcl~inances of the Municipality. On any side or rear yard fence, the supporting rails and posts shall face the interior of the property of the owner of the fence and shall not face the adjacent property; the finished side (as contrasted with the rough or unfinished side) of the fence shall face the property of the adjacent property owner. ~ ~ ~ G~c~ ~~~~~f~~ GU~~~ (~ ~ r9 ,,`r~ `l~l -~ `~ ~ j , ~J SECTION 2.
