See corrected page <br />ORDINANCE NO. 93- 34 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 1157.08(b) RELATING TO <br />PERMITTED FENCES IN RESIDENTIAL DISTRICTS <br />WHEREAS, it is recommended by the Ordinance Review Committee <br />that certain clarifications be set forth in the Codified Ordinances <br />relating to permissible fences in residential districts. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 1157.08 (b) of the Codified Ordinances <br />is hereby and herein amended to read as follows: <br />1157.08 FENCES; PERMIT; FEE. <br />~ ~ <br />(b) In Side and Rear Yards. In side yards and rear yards in <br />Class U-1, U-2, U-3AA Use Districts, the only fences permitted <br />shall be as follows: <br />Split Rail, Chain Link, Board and Board and Picket <br />fences. Board and Board fences are to be built so the <br />horizontal space between the vertical boards is 3 1/2". <br />Open fences not over four and one-half feet in height <br />shall be permitted along the side yards and along the rear lot <br />line, provided such fences shall have uniformly spaced <br />openings aggregating twenty-five percent of their surface <br />areas between residential properties. <br />However, in open or a closed fence not over eight feet in <br />height may be placed along the rear or side line which <br />separates residential property from property used for non- <br />residential purposes, subject to the written approval of the <br />Building Commissioner, who shall not give his approval if he <br />finds that such proposed fence is unsafe or unsightly or that <br />it obstructs necessary light and air from adjacent property or <br />that in some manner it does not conform with the ordinances of <br />the Municipality. <br />Or any side or rear yard fence, the supporting rails and <br />posts shall face the interior of the property of the owner of <br />the fence and shall not face the adjacent property; the <br />finished side (as contrasted with the rough or unfinished <br />side) of the fence shall face the property of the adjacent <br />property owner. <br /> <br />SECTION 2. The rest and remainder of Section 1157.08 shall <br />remain in full force and effect. <br />
