37 Drub Abuse Control 513.14 <br />(d) Whoever violates this section is guilty of trafficking in harmful intoxicants, <br />a misdemeanor of the fourth degree. If the offender previously has been convicted <br />of a drug abuse offense, trafficking in harmful intoxicants is a misdemeanor of the <br />third degree. <br />(e) This section does not apply to products used in making, fabricating, assembling, <br />transporting or constructing a product or structure by manual labor or machinery for <br />sale or lease to another person, or to the mining, ,refining or processing of natural deposits. <br />(ORC 2925.3?.) <br />513.12 RESERVED. <br />(ED.ITOR'S NOTE: This section has been reserved for future legislation.) <br />513.13 COUNTERFEIT CONTROLLED SUBSTANCES. <br />(a) No person shall knowingly possess any counterfeit controlled substance. <br />(b) Whoever violates this section is guilty of possession of counterfeit controlled <br />substances, a misdemeanor of the first degree if the offender has not previously been <br />convicted of a violation of this chapter or Ohio R.C. Chapter 2925. <br />(c) The provisions of this section shall not apply to a practitioner, pharmacist, <br />pharmacy owner or other person whose conduct is in accordance with Ohio R.C. <br />Chapters 3715, 3719, 4715, 4729, 4731 and 4741. <br />(ORC 2925.37) <br />513.14 ALLOCATION OF FINES IMPOSED FOR DRUG TRAFFICKING AND <br />RELATED ACTIVITIES. <br />(a) The Finance Director is hereby authorized and directed to establish a <br />Special Revenue Generic Fund Type which shall be known as the "Drug Law <br />Enforcement Fund". Moneys from this Fund shall be used to ~ subsidize the Police <br />Department's efforts that pertain to drug offenses. <br />(b) Whenever the Police Department is primarily responsible for or involved in <br />making the arrest of, and in prosecuting, any offender in violation of Ohio R.C. <br />2925.03, any mandatory fine imposed pursuant to that section shall be accounted for <br />in the "Drug Law Enforcement Fund". Any additional fine imposed pursuant to <br />Ohio R.C. 2925.03(I) shall be disbursed as otherwise provided by law. <br />(c) Whenever a person is charged with any violation of Ohio R.C. 2925.03 and <br />forfeits bail posted pursuant to Ohio R.C. 2937.22 and' 2937.46 or Criminal Rule 46, <br />the forfeited bail shall be accounted for in the "Drug Law Enforcement Fund". <br />(Ord. 89-44.
