ORDINANCE NO. 93- 42 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH THE STATE OF OHIO <br />FOR THE RELOCATION OF UTILITIES RELATIVE TO THE <br />EXPRESS LANES ON ROUTE 271 <br />WHEREAS, the State proposes to improve Interstate Route 271 <br />and Interstate Route 90 which will require the relocation of <br />certain water line facilities and other utilities; and <br />WHEREAS, the cost of such relocation will be absorbed by the <br />State of Ohio with federal aid funds that may be available; and <br />WHEREAS, it is the intention of this Ordinance to authorize <br />the agreement attached hereto as Exhibit A with the State of Ohio <br />relative thereto. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into the agreement with the Director of <br />Transportation of the State of Ohio as and for the relocation of <br />water line facilities and other utilities with reference to the <br />expansion and improvement of Interstate Route 271, as more <br />specifically set forth in Exhibit A attached hereto and <br />incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance 'with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby. declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
