ORDINANCE NO'. 9 3 - 4 4~ ` <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />WITH A&J CEMENT CONTRACTORS, INC. FOR THE HIGHLAND/ <br />S.O.M. CENTER INTERSECTION IMPROVEMENT <br />WHEREAS, the Village has advertised pursuant to law for bids for <br />the improvement to the Highland/S.O.M. Center intersection pursuant to <br />specifications on file with the Village; and <br />WHEREAS, the lowest and best bidder was that of A&J Cement <br />Contractors, Inc., in the amount of Five Hundred Seventeen Thousand <br />Seven Hundred Ninety Eight and 10/100 Dollars ($517,798.10). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with A&J Cement Contractors, Inc. <br />for an amount not to exceed Five Hundred Seventeen Thousand Seven <br />Hundred Ninety Eight and 10/100 Dollars ($517,798.10), as and for the <br />Highland/S.O.M. Center intersection improvement, and pursuant to the <br />terms of the specifications and advertisement for said improvement. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance have <br />been taken at open meetings of this Council; and that deliberations of <br />this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of <br />the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the <br />residents of.Mayfield Village, Ohio, and for the further reasons set <br />forth in the preamble hereof.
