ORDINANCE NO. 92-02 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO AN AGRE~iT WITH <br />GATES MILLS TOWERS FOR THE INSTALLATION, MAINTENANCE <br />AND OPERATION OF SPAN RADIO COMMUNICATIONS EQUIPMENT, <br />ANI? DECLARING AN EMERGENCY. <br />WHEREAS,. the Village of Mayfield is a member of and <br />participates in the Suburban Police Anti-Crime Network ("SPAN") for <br />the purpose of owning radio communications equipment; and <br />WHEREAS, the member cities of SPAN have reached an agreement <br />with Gates Mills Towers for the building and rooftop use of its <br />property located at 6805 Mayfield Road in Mayfield Heights, Ohio, <br />for the installations, maintenance and operation of radio <br />communication equipment for use by various police and fire <br />departments; and <br />WHEREAS, the Council of the Village of Mayfield desires to <br />authorize the Mayor to enter into the agreement concerning the use <br />of the property of Gates Mills Towers for .such purpose. <br />' NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Mayor Blase Pietrafese be and he is hereby <br />authorized and directed to enter into a building and rooftop use <br />agreement with Gates Mills Towers Apartment Co., an Ohio general <br />partnership, along with the Cities of Mayfield Heights, Highland <br />Heights, Richmond Heights,. Gates Mills and Lyndhurst providing for <br />the installation, maintenance and operation of the SPAN radio <br />communications equipment and system to be located at 6805 Mayfield <br />Road, Mayfield Heights, Ohio. Such agreement shall be in such form <br />as approved by the Director of Law. <br />SECTION 2. The Council finds and determines .that all formal <br />actions of this Council relating to the adoption of this Ordinances <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. The Ordinances is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, for the reasons <br />as stated in the preamble hereof.
