ORDINANCE NO. 92- 03 <br />-~ INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN ORDINANCE <br />REPEALLING ORDINANCE NO. 91-49, AND DECLARING AN EMERGENCY. <br />WHEREAS, Ordinance No. 91-49 was adopted on October 21, 1991, <br />and was the result of a referendum petition proposing to submit <br />Ordinance No. 91-35 to a vote of the people; and <br />WHEREAS, Ordinance No. 91-35 pertains to the necessity and <br />intention of appropriating certain property commonly know as the <br />Parkview Golf Course; and <br />WHEREAS, the petitionors sponsoring said referendum petition <br />have requested by a second petition to Council submitted on or <br />about January 20, 1992, requesting that the referendum be <br />withdrawn, and that the referendum election currently scheduled for <br />special election on February 4, 1992, be postponed for the purpose <br />of negotiations between the Village and the property owners. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Council does hereby and herein repeal <br />• Ordinance No. 91-49, and does further request that the Board of <br />__ Elections withdraw the referendum election currently scheduled for <br />Mayfield Village on February 4, 1992. <br />SECTION 2. The Clerk of Council is directed to certify a <br />copy of this Ordinance to the Board of Elections. <br />SECTION 3. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting <br />in such formal action, took place in meetings open to the public, <br />in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, for the reasons <br />as stated in the preamble hereof.
