ORDINANCE NO. 92- 03 -~ INTRODUCED BY: Mayor Pietrafese and Council as a Whole AN ORDINANCE REPEALLING ORDINANCE NO. 91-49, AND DECLARING AN EMERGENCY. WHEREAS, Ordinance No. 91-49 was adopted on October 21, 1991, and was the result of a referendum petition proposing to submit Ordinance No. 91-35 to a vote of the people; and WHEREAS, Ordinance No. 91-35 pertains to the necessity and intention of appropriating certain property commonly know as the Parkview Golf Course; and WHEREAS, the petitionors sponsoring said referendum petition have requested by a second petition to Council submitted on or about January 20, 1992, requesting that the referendum be withdrawn, and that the referendum election currently scheduled for special election on February 4, 1992, be postponed for the purpose of negotiations between the Village and the property owners. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Council does hereby and herein repeal • Ordinance No. 91-49, and does further request that the Board of __ Elections withdraw the referendum election currently scheduled for Mayfield Village on February 4, 1992. SECTION 2. The Clerk of Council is directed to certify a copy of this Ordinance to the Board of Elections. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reasons as stated in the preamble hereof.
