i" <br />ORDINANCE NO. 92-06 <br />INTRODUCED BY: Mayor Pietrafese <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN ADDITIONAL EXPENDITURE <br />FOR CONCRETE SIDEWALK WORK TO DC & SONS <br />WHEREAS, in the Fall of 1991, a sidewalk improvement program <br />was instituted throughout the Village; and <br />WHEREAS, the contractor encountered some additional work not <br />contemplated within the terms of the contract, in an amount greater <br />than $1,605.50; and <br />WHEREAS, through negotiations with the contractor, a <br />settlement has been reached for payment of an extra additional cost <br />in the amount of $1,605.50, as settlement of all claims. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor and Director of Finance are hereby <br />and herein authorized to make payment to DC & Sons in the amount of <br />$1,605.50 as and for additional costs and extras incurred during <br />the Fall, 1991, sidewalk improvement program. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, for the reason <br />to encourage commercial development within Mayfield Village. It <br />shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members lected to <br />Council and approval by the Mayor or~-trwise a~ h ~arli st time <br />allowed by law. ~ ~ ~ , , <br />First Reading: March 16 , 1992 <br />Second Reading: uspen e 1992 <br />Third Reading: uspen e 1992 <br />
