i" ORDINANCE NO. 92-06 INTRODUCED BY: Mayor Pietrafese AN EMERGENCY ORDINANCE AUTHORIZING AN ADDITIONAL EXPENDITURE FOR CONCRETE SIDEWALK WORK TO DC & SONS WHEREAS, in the Fall of 1991, a sidewalk improvement program was instituted throughout the Village; and WHEREAS, the contractor encountered some additional work not contemplated within the terms of the contract, in an amount greater than $1,605.50; and WHEREAS, through negotiations with the contractor, a settlement has been reached for payment of an extra additional cost in the amount of $1,605.50, as settlement of all claims. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor and Director of Finance are hereby and herein authorized to make payment to DC & Sons in the amount of $1,605.50 as and for additional costs and extras incurred during the Fall, 1991, sidewalk improvement program. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason to encourage commercial development within Mayfield Village.
