Ordinance No. 92 - 09 Page 21 <br />(1) Prohibit encroachments, including fill, <br />new construction, substantial <br />improvements, and other development <br />unless a hydrologic and hydraulic <br />analysis performed in accordance with <br />standard engineering practices <br />demonstrates that the proposed <br />encroachment would not result in any <br />increase in flood levels during the <br />occurrence of the base flood discharge. <br />(2) If Subsection (1) hereinabove is <br />satisfied, all new construction and <br />substantial improvements shall comply <br />with all applicable flood hazard <br />reduction provisions of Section 1375.16 <br />(C) . <br />(3) Any encroachment within the floodway that <br />would result in an increase in base flood <br />elevations can only be granted upon the <br />prior approval by the Federal Emergency <br />Management Agency. Such requests must be <br />submitted by the Village Engineer to the <br />Federal Emergency Management Agency and <br />must meet the requirements of the <br />National Flood Insurance Program. <br />1375.99 Penalty <br />Violation of the provisions of this Chapter or <br />failure to comply with any of its requirement shall <br />constitute a misdemeanor of the first degree. Any person <br />who violates this Chapter or fails to comply with any of <br />its requirements (including violations of conditions and <br />safeguards established in connection with conditions) <br />shall upon conviction thereof be fined or imprisoned as <br />provided by the,laws of Mayfield Village. Each day such <br />violation continues shall be considered a separate <br />offense. Nothing herein contained shall prevent Mayfield <br />Village from taking such other lawful action as is <br />necessary to prevent or remedy any violations. <br />SECTION 2. Existing Chapter 1375 is hereby amended to be <br />consistent herewith. <br />
