ORDINANCE NO. 92-11 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />REPEALING ORDINANCE NO. 91-35 AND <br />RESOLUTION N0. 91-63 RELATIVE TO THE <br />APPROPRIATION OF PROPERTY FOR PUBLIC PARK PURPOSES <br />WHEREAS, Council and the administration have determined that <br />it is no longer necessary nor desirable, at this time, to proceed <br />with the appropriation of property for public park purposes as <br />determined under Ordinance No. 91-35 and Resolution No. 91-63. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Ordinance No. 91-35, authorizing the <br />appropriation of property for public park purposes, and Resolution <br />No. 91-63, declaring the necessity and intention to appropriate a <br />fee simple interest in property for public park purposes, are <br />hereby and herein repealed. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, for the reason <br />to encourage commercial development within Mayfield Village.
