ORDINANCE NO. 92- 19 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 1153.02(g)(3), <br />EXPANDING THE DEFINITION OF "AUTO GRAVEYARD" <br />AND THE PROHIBITION OF SAME WITHIN THE VILLAGE <br />WHEREAS, certain property owners are creating a nuisance in <br />the Village by the storage of inoperable or dismantled vehicles on <br />blocks, or otherwise, which is a distraction to the community, a <br />health and safety hazard, and one which this Council is attempting <br />by this Ordinance to eliminate. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 1153.02 (g) (3) is hereby and herein <br />amended to read as follows: <br />(g) Class U-7 Uses: (Prohibited) <br />(3) Storage of scrap iron, scrap paper, rages or other <br />junk, and operation of junk or scrap yard or auto <br />graveyard. A junk or scrap yard shall mean land <br />open to the sky, used as a place of storage or <br />deposit of scrap metal, papers, rags or glass. An <br />auto graveyard is a place containing one or more <br />unhoused,dismantled or disabled motor vehicle <br />without current year Ohio license plates; or a <br />vehicle on blocks with or='without current license <br />plates. Any vehicle stored outside must be <br />ot~erable and in good appearance, and~if temporarily <br />inoperable, the maximum storage of an inoperable <br />vehicle is sixty (60) days, providing same is not <br />on blocks. Any dispute with the interpretation or <br />enforcement of this Section can be appealed to the <br />Board of Zoning Appeals. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory. requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, for the reason <br />to encourage commercial development within Mayfield Village. It <br />shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />
