ORDINANCE NO. 92-20 <br />INTRODUCED BY: Mayor Pietrafese <br />AN EMERGENCY ORDINANCE <br />CREATING SECTION 525.021 PROHIBITING <br />THE GIVING OF FALSE INFORMATION <br />TO LAW ENFORCEMENT OFFICERS <br />WHEREAS, there have been some major court decisions relevant <br />to the offense of giving false information to a law enforcement <br />officer; and <br />WHEREAS, it is the intent of this ordinance to create a <br />section within the Codified Ordinances which is in compliance with <br />recent court decisions pertaining to the giving of false <br />information to a law enforcement officer. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 525.021 is hereby and herein created <br />to read as follows: <br />525.021 GIVING FALSE INFORMATION TO LAW ENFORCEMENT OFFICERS. <br />(a) No person shall knowingly give or assist in giving false <br />information, relative to name, address or date of birth of any <br />person, to any law enforcement officer as defined in this <br />Code, with the purpose to mislead the officer in performing <br />his official function. <br />(b) Whoever violates this section is guilty of giving false <br />information, a misdemeanor of the first degree. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
