4 <br /> <br />1158.13 CLUSTER AREA IMPROVES NT . <br />' The developer of a cluster area shall submit to the <br />Village Engineer for his approval, the detailed design of all <br />improvements of a cluster area, to include the pavement, storm <br />sewers, sanitary sewers, water mains, sidewalks and Cleveland <br />Electric Illuminating and Ohio Be11 Telephone lines. This <br />submission shall conform to the requirements of the Village <br />Engineer and Council for plans and specifications with respect <br />to the construction and material standards for all pavement and <br />utility installations within the Municipality. <br />Utility improvements in a cluster area, if approved by <br />the Planning Commission and Engineer, need not be installed in <br />a dedicated right of way. In all instances where such <br />improvements are not installed in a dedicated right of way and <br />the operation and maintenance of such utilities are to be <br />performed by the Municipality or other public utility, the <br />owner shall grant permanent easements to the Village and/or the <br />appropriate public utility, in a form satisfactory to the Law <br />Director and Engineer, providing for access to the utilities by <br />the Municipality and/or other utility companies. <br />All streets in a residential planned unit development <br />must be offered for dedication to the Village. The Planning <br />Commission may, however, permit right of ways and pavement <br />dimensions of less than the minimum requirements set forth in <br />the Subdivision Regulations, if approved by the Village Engineer <br />and Council. The procedures and requirements for the dedication <br />of streets in a residential planned unit development shall meet <br />;~ all other standards set forth in the Subdivision Regulations. <br />1158.1? PUBLIC FACILITIES. <br />Upon receipt of an application for preliminary plan <br />approval under this chapter, the Secretary of the Planning <br />Commission shall notify the Mayfield Board of Education. The <br />Board and its officers and employees shall be afforded an <br />opportunity to review t;Ze proposed preliminary plan to determine <br />its probable impact upon the need for a future school site, .and <br />to afford the Board an opportunity to negotiate or appropriate <br />the acquisition of additional lands for school purposes. If the <br />Board determines that an additional school site is required <br />within the proposed development area, it may notify the <br />Planning Commission and the developer in order to permit them <br />the opportunity to incorporate a proposed site into the <br />development plan. <br />Not more than one-half of a required school site <br />area may comprise required open space area within a residential <br />planned unit development, provided that such portion of the <br />school site area is dedicated to public use by the developer. <br />8 <br />~- <br />
