*Note: Repealed by Ord. 93-49 12/6/93 <br />ORDINANCE NO. 92- 42 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />DECLARING THE NECESSITY AND INTENTION TO <br />APPROPRIATE FOR MUNICIPAL PURPOSES A FEE <br />SIMPLE INTEREST IN AND TO THE PREMISES AS <br />DESCRIBED IN THE ATTACHED EXHIBITS <br />WHEREAS, in promotion of the health, safety and welfare of the <br />residents of the Village of Mayfield, it is necessary for the <br />Village to appropriate for municipal purposes a fee simple interest <br />in and to the premises described in the attached exhibits. <br />' NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That this Council considers it necessary and <br />declares its intention to appropriate for construction of municipal <br />buildings and other facilities a fee simple interest in and to the <br />premises as described in the attached Exhibits "A", "B" anal "C". <br />SECTION 2. That the Mayor is authorized to cause written <br />notice of the passage of this resolution to be given to the owners <br />and persons in possession or having an interest of record in the <br />premises; and that notice shall be served and returned according to <br />law. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
