ORDINANCE NO. 92-43 INTRODUCED BY: Mayor Pietrafese and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH KING EXCAVATING, INC. WITHOUT THE NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING FOR AN AMOUNT NOT TO EXCEED ELEVEN THOUSAND EIGHT HUNDRED SIXTY-FIVE DOLLARS ($11,865.00) WHEREAS, Section 735.051 of the Ohio Revised Code provides that in the case of a real and present emergency arising in connection with the maintenance and operation of any municipal department, the legislative authority may, by two-thirds (2/3) vote of all its members elected thereto, authorize the Mayor to enter into a contract for the immediate improvement of public property without formal bidding and advertising; and WHEREAS, it has been deemed a real and present emergency to excavate, clean and fill the compost area before the inclement weather prohibits same, in the Village of Mayfield without the necessity of formal bidding and advertising; and WHEREAS, it is the intent of Council to authorize the Mayor of the Village to enter into a contract-for the excavating, cleaning and filling of the compost area without the necessity of legal advertisement and formal bidding, in order to immediately protect the Village and to prevent a threat to the health, safety and welfare of the Village residents, which will occur if there is a delay in the awarding of this contract. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into a contract for the emergency excavation, cleaning and filling of the compost area with King Excavating, Inc. pursuant to the quote which is attached thereto and incorporated herein as Exhibit "A". The Mayor is authorized to enter into such an agreement without advertising and formal bidding and that the same is necessitated by a real and present emergency. SECTION 2. Said contract is hereby authorized for an amount not to exceed Eleven Thousand Eight Hundred Sixty-Five Dollars ($11,865.00) and that the Director of Finance is hereby authorized and directed to make such payment out of the appropriate fund of the Village. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
