ORDINANCE NO. 92-43 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH KING <br />EXCAVATING, INC. WITHOUT THE NECESSITY OF ADVERTISEMENT <br />AND FORMAL BIDDING FOR AN AMOUNT NOT TO EXCEED ELEVEN <br />THOUSAND EIGHT HUNDRED SIXTY-FIVE DOLLARS ($11,865.00) <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides <br />that in the case of a real and present emergency arising in <br />connection with the maintenance and operation of any municipal <br />department, the legislative authority may, by two-thirds (2/3) vote <br />of all its members elected thereto, authorize the Mayor to enter <br />into a contract for the immediate improvement of public property <br />without formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />excavate, clean and fill the compost area before the inclement <br />weather prohibits same, in the Village of Mayfield without the <br />necessity of formal bidding and advertising; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of <br />the Village to enter into a contract-for the excavating, cleaning <br />and filling of the compost area without the necessity of legal <br />advertisement and formal bidding, in order to immediately protect <br />the Village and to prevent a threat to the health, safety and <br />welfare of the Village residents, which will occur if there is a <br />delay in the awarding of this contract. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into a contract for the emergency excavation, <br />cleaning and filling of the compost area with King Excavating, Inc. <br />pursuant to the quote which is attached thereto and incorporated <br />herein as Exhibit "A". The Mayor is authorized to enter into such <br />an agreement without advertising and formal bidding and that the <br />same is necessitated by a real and present emergency. <br />SECTION 2. Said contract is hereby authorized for an amount <br />not to exceed Eleven Thousand Eight Hundred Sixty-Five Dollars <br />($11,865.00) and that the Director of Finance is hereby authorized <br />and directed to make such payment out of the appropriate fund of <br />the Village. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
