NUNC PRO TUNC <br />RESOLUTION NO. 92- 08 <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AMENDING RESOLUTION NO. 87-65 <br />EXPANDING THE SPECIAL USE PERMIT <br />GRANTED TO ALLAN AND WANDA HEJCL <br />TO THEIR CHILDREN, ALLAN, JR. AND SALLY <br />HEJCL DELEONIBUS, AND DECLARING AN EMERGENCY <br />WHEREAS, the Hi-Bank Florist Shop was granted a special use <br />permit in Resolution No. 87-65, on September 21, 1987; and <br />WHEREAS, the special use permit was granted personally to <br />Allan and Wanda Hejcl and it is the intention of this Resolution to <br />amend Resolution No. 87-65 by including the children, Allan Hejcl, <br />Jr. and Sally Hejcl DeLeonibus, as personal beneficiaries of this <br />special use permit. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 2 of Resolution No. 87-65 is hereby <br />and herein amended to include the names Al1an Hejcl, Jr. and Sally <br />Hejcl DeLeonibus as additional persons who personally are granted <br />a special use permit under the terms of said resolution. <br />- SECTION 2. That said beneficiaries, Allan Hejcl, Jr. and <br />Sally Hejcl DeLeonibus are bound by all other terms and conditions, <br />as well as any restrictions contained therein, in Resolution No. <br />87-65, as amended. <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that such plan was necessary to encourage orderly <br />development in Mayfield Village. It shall, therefore, take effect <br />immediately upon passage by the affirmative vote of no less than <br />five (5) members elected to Counci a d approv ?1 th yor or <br />otherwise at the earliest time al law.f \I /? <br />RINKER, <br />1 President
