RESOLUTION NO. 2009-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION ESTABLISHING <br />AN IDENTITY THEFT PREVENTION, DETECTION <br />AND MITIGATION PROGRAM. <br />WHEREAS, the Federal Trade Commission ("FTC") and other regulatory agencies <br />have documented the prevalence and dangers of identity theft, including medical identity <br />theft; and <br />WHEREAS, in response to this growing problem, Congress, in the Fair and <br />Accurate Credit Transactions Act of 2003 ("FACT Act"), directed the FTC and certain <br />bank regulatory agencies to promulgate regulations addressing identity theft; and <br />WI IEREAS, pursuant to the FACT Act, the FTC and bank regulatory agencies have <br />enacted regulations, commonly known as the "Red Flag Rules" ("Rules"), requiring that <br />creditors who maintain covered accounts implement a program to detect, prevent and <br />mitigate identity theft, including medical identity theft; and <br />WHEREAS, pursuant to FTC interpretations, the Village is subject to the Rules. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Village hereby adopts the attached Policy/Procedure for <br />Identity Theft Prevention, Detection and Mitigation Program ("Program"), as required by <br />the Rules. <br />SECTION 2. That the Village hereby appoints the Fire Chief s Executive Assistant <br />as the official within the organization responsible for oversight, ongoing development, <br />implementation and administration of the Program. <br />SECTION 3. The Council finds and determines that all formal actions of the <br />Council relating to the adoption of this Resolution have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code.
