ORDINANCE NO. 2007-14 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A WATER POLLUTION CONTROL LOAN FUND AGREEMENT WITH THE OHIO ENVIRONMENTAL PROTECTION AGENCY AND THE OHIO WATER DEVELOPMENT AUTHORITY WHEREAS, the Ohio Water Development Authority has been created to carry forward the public policy of the State of Ohio to preserve, protect, upgrade, conserve, develop, utilize and manage the water resources of the State, to prevent or abate the pollution of water resources, to promote the beneficial use of waters of the State for the protection and preservation of the comfort, health, convenience, and welfare, and the improvement of the economic and general welfare and employment opportunities of and the creation of jobs for the people of the State, and to assist and cooperate with other governmental agencies in achieving such purposes through the establishment, operation and maintenance of water development projects pursuant to Chapter 6121 of the Revised Code; and WHEREAS, the Ohio General Assembly has created a Water Pollution Control Loan Fund ("WPCLF") to provide loans and other types of financial assistance to facilitate the public policy of the State of Ohio; and WHEREAS, the Village is desirous of obtaining financing for certain water development projects in the Village using funds from the Water Pollution Control Loan Fund ("WPCLF"); and WHEREAS, in order to obtain this financing the Village is required to enter into an agreement with the Ohio Environmental Protection Agency and the Ohio Water Development Authority; and WHEREAS, Village Council finds it in the best interest of the health, safety and welfare of the community to enter into this agreement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor is hereby and herein authorized and directed to enter into a Water Pollution Control Loan Fund Agreement with the Ohio Water Development Authority and the Ohio Environmental Protection Agency to provide the Village the ability to obtain financing for certain water development projects in the Village in an effort to carry out the purposes of the Ohio Water Development Authority in the Village, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A". SECTION 2. The Law Director and Director of Finance are authorized to execute and carry out all documents required to enter into this Agreement.
