ORDINANCE NO. 2007-14 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR <br />TO ENTER INTO A WATER POLLUTION CONTROL LOAN FUND AGREEMENT <br />WITH THE OHIO ENVIRONMENTAL PROTECTION AGENCY <br />AND THE OHIO WATER DEVELOPMENT AUTHORITY <br />WHEREAS, the Ohio Water Development Authority has been created to carry <br />forward the public policy of the State of Ohio to preserve, protect, upgrade, conserve, <br />develop, utilize and manage the water resources of the State, to prevent or abate the <br />pollution of water resources, to promote the beneficial use of waters of the State for the <br />protection and preservation of the comfort, health, convenience, and welfare, and the <br />improvement of the economic and general welfare and employment opportunities of and <br />the creation of jobs for the people of the State, and to assist and cooperate with other <br />governmental agencies in achieving such purposes through the establishment, operation <br />and maintenance of water development projects pursuant to Chapter 6121 of the Revised <br />Code; and <br />WHEREAS, the Ohio General Assembly has created a Water Pollution Control Loan <br />Fund ("WPCLF") to provide loans and other types of financial assistance to facilitate the <br />public policy of the State of Ohio; and <br />WHEREAS, the Village is desirous of obtaining financing for certain water <br />development projects in the Village using funds from the Water Pollution Control Loan <br />Fund ("WPCLF"); and <br />WHEREAS, in order to obtain this financing the Village is required to enter into an <br />agreement with the Ohio Environmental Protection Agency and the Ohio Water <br />Development Authority; and <br />WHEREAS, Village Council finds it in the best interest of the health, safety and <br />welfare of the community to enter into this agreement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is hereby and herein authorized and directed to enter into <br />a Water Pollution Control Loan Fund Agreement with the Ohio Water Development <br />Authority and the Ohio Environmental Protection Agency to provide the Village the ability to <br />obtain financing for certain water development projects in the Village in an effort to carry <br />out the purposes of the Ohio Water Development Authority in the Village, a copy of which <br />is attached hereto and incorporated herein by reference as Exhibit "A". <br />SECTION 2. The Law Director and Director of Finance are authorized to execute <br />and carry out all documents required to enter into this Agreement. <br />
