RESOLUTION NO. 2007-10 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />EXPRESSING OPPOSITION TO THE FEDERAL DRUG ADMINISTRATION'S ("FDA") <br />ANNOUNCEMENT OF ITS PROPOSED <br />"GUIDANCE FOR COMPLEMENTARY AND ALTERNATIVE MODALITIES ("CAM") <br />PRODUCTS AND REGULATION" <br />WHEREAS, CAM health products and practices can generally be defined as <br />traditional or other practices that are used by individuals, often for self-help, to achieve and <br />maintain a health status, either on their own or complementary to standard medical care, <br />such as vitamins and minerals; and <br />WHEREAS, the FDA recently announced a draft of its "Guidance For CAM Products <br />and Regulation" which if adopted will classify CAM products as "medicine" so that only <br />licensed physicians can carry out their use; and <br />WHEREAS, more specifically, this classification will result in vitamins, and minerals <br />being considered untested drugs; and <br />WHEREAS, if the Guidance for CAM Products and Regulation is approved, the <br />ability to look for traditional methodologies and leading-edge CAM techniques, because <br />they offer alternatives to toxic, expensive drugs with their dangerous side effects, <br />unmanageable and unreasonable costs and other invasive technologies of modern <br />medicine, will be lost along with the fundamental right of individuals to communicate and <br />learn; to heal and be healed. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Village Council and the Mayor wish to express their opposition to the <br />FDA's proposed "Guidance For CAM Products and Regulation" and urges that it not be <br />adopted. <br />SECTION 2. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of the residents <br />of Mayfield Village.
