RESOLUTION NO. 2007-19 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />APPROVING OF THE RECOMMENDATION <br />OF THE VILLAGE'S PLANNING AND ZONING COMMISSION <br />CONCERNING THE EXPANSION OF THE HEINEN'S FACILITY <br />LOCATED AT 860 SOM CENTER ROAD, MAYFIELD VILLAGE, OHIO <br />WHEREAS, on December 3, 2007 the Village's Planning and Zoning Commission <br />considered a proposal submitted by Heinen's for the expansion of their facility located at <br />860 SOM Center Road, Mayfield Village, Ohio; and <br />WHEREAS, the proposal included the expansion of the east and south sides of the <br />existing building and a new entrance on the north of the building; and <br />WHEREAS, the addition of the north entrance to the building will require the use of <br />approximately 308 square feet of Village-owned land currently used as parking for the <br />Village's Civic Center; and <br />WHEREAS, in order to facilitate the use of the Village's property for the addition of <br />the north entrance, the Planning and Zoning Commission granted Heinen's a Conditional <br />Use Permit for the land pursuant to Chapter 1149 of the Village's codified ordinances; and <br />WHEREAS, as conditions to the approval of the Conditional Use Permit, the Village <br />is requiring that Heinen's enter into a Ground Lease Agreement for the use of the 308 <br />square feet of Village owned land and a Parking Easement allowing Heinen's the use of <br />the current Civic Center Parking lot as shared parking at the north entrance; and <br />WHEREAS, the Village's Planning and Zoning Commission approved of the <br />Heinen's expansion including the expansion on the east and south sides of the building <br />and the north entrance and also granted Heinen's a conditional use permit for the use of <br />the 308 square feet of Village owned land with the conditions as aforesaid; and <br />WHEREAS, the Village's Planning and Zoning Commission will be considering <br />certain other improvements on Village-owned land in this area to coordinate the proper <br />ingress and egress between the Civic Center Parking Lot and the existing Heinen's Parking <br />Lot and in an effort to facilitate the recommendations set forth in the Village's Master Plan <br />for the Town Center.
