09/18/2008 THU 15:01 FAx E005/010
" Pianning and Zoning Meet'ing Minutes
December 3, 2007
? Page 4
? Mr. Marquardt stated that he is not going by, the use for ViIlage purposes. Every propez'ty
' we buy does not automatically turn inta residential. There was a vote in 2000 to aonvert
• what was at that time the layercake that al1 of the Village propetty would be residential.
?
Using #Mt same trend af thought, Mr. Nlarratl'e asked if that means that the house lot that
has been purchased on Seneca cauld be designated for retail or comrnercial without
consent of the vaters. Mr. Diemert reglied that the homes are close together, If y'ou wece
to put any kind of retai] in there that would be contradictory to the best interests o£ the
communiiy. Mz. I?,rlarxotte sta.fed that it doES not mean that the ViIlage could not do xt,
Mr. Diemiext saad that they could not do it legally and get away with it. It would be a
nuisance to the neighbors and an abuse of ouz authoxity. This is already a commercial
retaiI cen#er of the Village. By your goixtg into a garhlership and adding another eatrance,
it is not really expanding the retail aspects of things, It is just helping making it more
fluid.
Mr. Marquatdt asked Mr. Diemert if lze is recommending a conditional use permit by
virtue of the fact that we do not have to follaw our ordinances because we can't give a
conditional use permit on residential property. Mr. rJiemert advised that he did give
opinions years ago an Skoda .1VXinotta when he wanted to buy tlu'ee pxopexdes of ours
alon,g S.O.N,C,Centex for paxXcing. Iiis opinion was that they could not buy our propexty
and use it £or packing foz their commercnal enteiprise. If they wanted to Iease it from us
and we pvvned it that vvould be A way to do it. Yf we own it, we can cucumvent the
zonizxg. If it was to the public's interest t.o do th4 xi could have been done but Council at
the time chose not to do that.
Mr. I7iemert stated that the M[astex Plan is something yau need ta look at. Vije have put a
lot of tame, energy and money inta the Master Plan for this area. This kind of fits within
the town center Master Plan. That is wbat you want to pay crede:ace to, nat so much the
constituti4nai blackletter law of the ardinances but more what is the besi: t.laxng in the
overall plan.
Catxying it one step further, Mr. Jochuzn asked about tb.e house naw out here that we
own. If someone decided to use that for oomrnercial use, haw wou[d that woxk7 IVIr.
Diemert replxed, if it fib iw wi.th the Master Plan and was cohesive to what is already here.
We did talk about hospital iype uscs far that area. We .were trying to work out a
landswap with the Clinic across the slreet that would put a flovuing type of thing in here.
We thought that woultl worlc. It is agai.nst thc zonsng, but if we leased it and worked it out
where we bad a goad thing for the public, it wauld not be a bad idea. We talked about a
library at Qne tame. Again, that is not a permitted use, but it fits in with the town oanter
concept where people want to go to get whatever tlaey nesd. That concept is what we are
striving for in the IQng :range for ihe Village.
Mr.Marrelli stated that we might just be: alzitle ahead of tihe curve. At sornc point, Mr.
Marrelli expects thc 2020 Committee io come up with same kind ot zoniaxg that wauld
classify mxxed use areas or agoveruuaenta! institutional zoning.with public buildings, but
i# seems like the approaches are happening befbre we Ca.n get the, OXdinanees on the
boaks.
