RESOLUTION NO. 2006-03 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION IN SUPPORT OF HOUSE BILL NO. <br />294 ESTABLISHING A PROCESS TO EXPEDITE FORECLOSURE <br />PROBLEMS THAT CURRENTLY EXIST <br />WHEREAS, for years, vacant, abandoned and vandalized properties in our <br />communities have proven vexing to community and neighborhood development <br />groups. Every year, communities spend hundreds of thousand of dollars <br />cleaning, demolishing and pursuing the elusive owners of these properties; and, <br />WHEREAS, the County Treasurers throughout the State are charged <br />initially with certifying these properties as delinquent and turning them over to the <br />County Prosecutor to foreclose on account of the delinquent taxes; and, <br />WHEREAS, unfortunately, for properties undergoing the tax foreclosure, <br />the process can be dauntingly long, sometimes two (2) years or more. The <br />lengthy process is attributable to heavy foreclosure dockets, statutorily imposed <br />procedural impediments, and occasional human resource problems; and, <br />WHEREAS, House Bill 294 proposes to provide one more tool in this battle <br />to expedite the process; and, <br />WHEREAS, House Bill 294 proposes that a very limited select group of real <br />estate tax foreclosures cases be prosecuted administratively in the respective County <br />Boards of Revision. The proposed bill would statutorily define abandoned, unoccupied <br />tax delinquent properties, and allow the tax foreclosure of these properties to be <br />adjudicated in these local Boards of Revision. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, STATE OF OHIO, THAT: <br />SECTION 1. This Council hereby supports House Bill No. 294 to authorize a <br />procedure to expedite foreclosures by allowing a very limited select group of real estate <br />foreclosure cases to be prosecuted administratively in the respective County Boards of <br />Revision. <br />SECTION 2. That the Clerk of Council be, and is hereby and herein directed to <br />forward a certified copy of this Resolution to State Senators Daniel Brady and Robert <br />Spada; State Representative Sally Conway Kilbane, and Cuyahoga County Treasurer <br />Jim Rokakis. <br />SECTION 3. The Council finds and determines that all formal actions of the <br />Council relating to the adoption of this Resolution have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />
