RESOLUTION NO. 2006-05 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION OPPOSING THE <br />PROPOSED TAX EXPENDITURE LIMITATION <br />CONSTITUTIONAL AMENDMENT AND SIMILAR PROPOSALS <br />TO BE ON THE STATE-WIDE NOVEMBER 2006 BALLOT <br />WHEREAS, various elected officials, organizations and individuals are endorsing <br />proposals to amend the Ohio Constitution to institute constitutionally mandated Tax <br />Expenditure Limitations ("TEL") at the state and local levels of government; and <br />WHEREAS, one such proposal is commonly known as the Taxpayers' Bill of Rights <br />("TABOR") or the Tax Expenditure Limitation Amendment ("TEL"); and <br />WHEREAS, those states that have instituted proposals similarto the TEL proposal, <br />such as the State of Colorado, now face severe problems in meeting basic needs and have <br />reduced expenditures for K-12 education support, higher education and immunizations and <br />prenatal care and, as a result, the voters suspended key aspects of the law in November of <br />2005; and <br />WHEREAS, such TEL proposals would severely limit the fiscal management options <br />of elected state and local leaders in times of crisis and other unpredictable circumstances, <br />circumventing thoughtful and deliberate consideration of policy decisions; and <br />WHEREAS, such TEL proposals would undercut state constitutional provisions <br />requiring state support of education and requiring the repeal of all state laws that conflict <br />with the proposals; <br />WHEREAS, such TEL proposals would reduce funding for education, health care, <br />public safety, libraries, economic development and other vital services, by limiting annual <br />aggregate expenditure increases from the previous years' expenditures; and <br />WHEREAS, such TEL proposals would grant veto power to non-voters, and a <br />perversion of the democratic process, by creating asuper-majority requirement that few <br />political subdivisions could meet; and <br />WHEREAS, amending the Constitution is a virtually irrevocable action and should <br />only be undertaken when legislative remedies have proven enduringly inadequate; and <br />
