RESOLUTION NO. 2006-09 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY RESOLUTION DECLARING THE VILLAGE'S 1992 EMERGENCY ONE, 75-FOOT LADDER TRUCK AS SURPLUS AND AUTHORIZING ITS SALE TO THE CITY OF HIGHLAND HEIGHTS WHEREAS, the Village has purchased and received a new laddertruckwhich is in the process of being placed in service for the Village; and WHEREAS, the City of Highland Heights is in agreement to pay Mayfield Village One Hundred and Fifty Thousand Dollars ($150,000.00) forthe Village's 1992 Emergency One, 75-foot ladder truck; and WHEREAS, this Council wishes to declare the 1992 Emergency One, 75-foot ladder truck as surplus and authorize its sale to the City of Highland Heights for an amount of One Hundred and Fifty Thousand Dollars ($150,000.00). NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. It is hereby declared and decreed that the 1992 Emergency One, 75-foot ladder truck is surplus and shall be sold to the City of Highland Heights for the sum or One Hundred and Fifty Thousand Dollars ($150,000.00) with the understanding that the truck is being sold in its "as is" condition, with no implied warranties and with the City of Highland Heights assuming full responsibility for the truck in its "as is" condition. SECTION 2. The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
