RESOLUTION NO. 2006-09 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION DECLARING <br />THE VILLAGE'S 1992 EMERGENCY <br />ONE, 75-FOOT LADDER TRUCK AS SURPLUS <br />AND AUTHORIZING ITS SALE TO THE CITY OF <br />HIGHLAND HEIGHTS <br />WHEREAS, the Village has purchased and received a new laddertruckwhich <br />is in the process of being placed in service for the Village; and <br />WHEREAS, the City of Highland Heights is in agreement to pay Mayfield <br />Village One Hundred and Fifty Thousand Dollars ($150,000.00) forthe Village's 1992 <br />Emergency One, 75-foot ladder truck; and <br />WHEREAS, this Council wishes to declare the 1992 Emergency One, 75-foot <br />ladder truck as surplus and authorize its sale to the City of Highland Heights for an <br />amount of One Hundred and Fifty Thousand Dollars ($150,000.00). <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. It is hereby declared and decreed that the 1992 Emergency <br />One, 75-foot ladder truck is surplus and shall be sold to the City of Highland Heights <br />for the sum or One Hundred and Fifty Thousand Dollars ($150,000.00) with the <br />understanding that the truck is being sold in its "as is" condition, with no implied <br />warranties and with the City of Highland Heights assuming full responsibility for the <br />truck in its "as is" condition. <br />SECTION 2. The Council finds and determines that all formal actions of the <br />Council relating to the adoption of this Resolution have been taken at open meetings <br />of this Council; and that deliberations of this Council and of its committees, resulting <br />in such formal action, took place in meetings open to the public in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio <br />Revised Code. <br />
