RESOLUTION NO. 2006-12 INTRODUCED BY: Mayor Rinker and Council as a Whole A RESOLUTION AUTHORIZING THE MAYOR AND/OR FINANCE DIRECTOR TO APPLY FOR, ACCEPT, AND ENTER INTO A WATER POLLUTION CONTROL LOAN FUND AGREEMENT ON BEHALF OF MAYFIELD VILLAGE FOR PLANNING, DESIGN AND/OR CONSTRUCTION OF WASTEWATER FACILITIES; AND DESIGNATING A DEDICATED REPAYMENT SOURCE FOR THE LOAN. Whereas, Mayfield Village seeks to upgrade its existing wastewater facilities; and Whereas, Mayfield Village intends to apply for Water Pollution Control Loan Fund (WPCLF) for the planning, design and/or construction of the wastewater facilities; and Whereas, the Ohio Water Pollution Control Loan Fund requires the governmental authority to pass legislation for application of a loan and the execution of an agreement as well as designating a dedicated repayment source; now therefore, BE IT RESOLVED by the Council of Mayfield Village, Ohio: SECTION 1. That the Mayor and/or Finance Director be and are hereby authorized to apply for a WPCLF loan, sign all documents for and enter into a Water Pollution Control Loan Fund with the Ohio Environmental Protection Agency and the Ohio Water Development Authority for planning, design and/or construction of wastewater facilities on behalf of Mayfield Village, Ohio. SECTION 2. That the dedicated source of repayment will be a combination of special assessments and transfers from the Sewer Relief Fund to the General Bond Retirement Fund. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
