RESOLUTION NO. 2006-12 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />A RESOLUTION AUTHORIZING THE MAYOR AND/OR FINANCE <br />DIRECTOR TO APPLY FOR, ACCEPT, AND ENTER INTO A WATER <br />POLLUTION CONTROL LOAN FUND AGREEMENT ON BEHALF OF <br />MAYFIELD VILLAGE FOR PLANNING, DESIGN AND/OR CONSTRUCTION <br />OF WASTEWATER FACILITIES; AND DESIGNATING A DEDICATED <br />REPAYMENT SOURCE FOR THE LOAN. <br />Whereas, Mayfield Village seeks to upgrade its existing wastewater <br />facilities; and <br />Whereas, Mayfield Village intends to apply for Water Pollution Control <br />Loan Fund (WPCLF) for the planning, design and/or construction of the wastewater <br />facilities; and <br />Whereas, the Ohio Water Pollution Control Loan Fund requires the <br />governmental authority to pass legislation for application of a loan and the <br />execution of an agreement as well as designating a dedicated repayment source; <br />now therefore, <br />BE IT RESOLVED by the Council of Mayfield Village, Ohio: <br />SECTION 1. That the Mayor and/or Finance Director be and are hereby <br />authorized to apply for a WPCLF loan, sign all documents for and enter into a <br />Water Pollution Control Loan Fund with the Ohio Environmental Protection <br />Agency and the Ohio Water Development Authority for planning, design and/or <br />construction of wastewater facilities on behalf of Mayfield Village, Ohio. <br />SECTION 2. That the dedicated source of repayment will be a combination <br />of special assessments and transfers from the Sewer Relief Fund to the General <br />Bond Retirement Fund. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />
