ORDINANCE NO. 2006-05 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AMENDING CODIFIED ORDINANCE 1159.05(a) <br />BY INCLUDING A 60-FOOT (60') LOT FRONTAGE REQUIREMENT <br />FOR DEVELOPMENTS IN A PLANNED <br />RESIDENTIAL DEVELOPMENT DISTRICT <br />WHEREAS, upon review and discussion by the Village's Planning and <br />Zoning Commission and the Village's Ordinance Review Committee and further <br />review and recommendation of the Village's Building Commissioner, it has been <br />deemed in the best interest of the health, safety and welfare of all Village <br />residents to amend Codified Ordinance Section 1159.05(a) by adding a minimum <br />frontage requirement for a planned residential development district of a 60-foot <br />(60') lot frontage upon and abutting a dedicated street. Furthermore, this <br />frontage requirement shall remain undiminished or no less than 60' into the <br />development acreage. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br />MAYFIELD VILLAGE, OHIO: <br />SECTION 1. That Codified Ordinance Section 1159.05(a) be amended as <br />more specifically set forth in the Exhibit attached hereto and incorporated herein <br />as Exhibit "A". <br />SECTION 2. That this amendment shall be applicable to all applications <br />submitted on or after February 1, 2006. <br />SECTION 3. That the rest, residue and remainder of all Village <br />Ordinances shall remain as presently drafted unless inconsistent with this <br />ordinance. <br />SECTION 4. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />SECTION 5. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the <br />residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately <br />upon the passage by the affirmative vote of not less than five (5) members
