? <br />, ,. <br />. <br />WILSON MILLS ROAD CULVERT NO. 9 <br />2006-11 <br />ORDINANCE NO: <br />DATE: C <br />An einergency ordinance enacted by Mayfield Village, Cuyahoga County, Ohio hereinafter <br />referred to as the MUNICIPALITY, in the matter of the hereinafter described improvement and <br />requests the cooperation of the County of Cuyahoga by its Boazd of County Corrunissioners, <br />hereinafter referred to as the COUNTY. <br />WHEREAS, the MiJNICIPALITY has recognized the need for and proposes the <br />nnprovement of a portion of public lughway which is desciiUed as follows: <br />The replacement of Wilson Mills Road Culvert No.9 over Beechers Brook in Mayfield <br />Village. <br />NOW THEREFORE, be it ordained by the Council of Mayfield Village, County of Cuyahoga <br />and State of Ohio; <br />A. CONSENT <br />That it is declared to be in the public interest that the consent of said MLTNICIPALITY be <br />and such consent is hereby given to the COUNTY to participate in the cost of construction <br />of the above described improvement. <br />B. COOPERATION <br />1. That the COLJNTY and the MUNICIPALITY will cooperate in replacement of Wilson <br />Mills Road Culvert No. 9 over Beechers Brook in Mayfield Village. <br />2. That tlie MLTNICIPALITY will prepare construction plans and specifications, including <br />necessary engineering reports, which sha11 conform to generally accepted engineering <br />practices and principles. That the MiJNICIPALITY will arrange for the supervision and administration of the <br />construction contract. <br />4. That the COUNTY will review the construction plans for conformance with section B-2 of <br />this Ordinance. County approval of plans and specifications is required prior to the award <br />of the construction contract. The COUNTY will make an inspection of the completed <br />project. <br />5. That the MUNICIPALLITY shall agree to provide the COiJNTY with a complete set of <br />as -built plans upon the coinpletion of the project. <br />C. FUNDING <br />1. That the MLJNICIPALITY hereby agrees to pazticipate with the COLTNTY in the cost of <br />the unprovement by an allocation from the County Motor Vehicle License Tax Fund to pay <br />the COUNTY portion of the project. <br />-1-
