ORDINANCE NO. 2006-16 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDIfVANCE AMENDING CHAPTER 1149 <br />OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE <br />PERTAINING TO SPECIAL, TEMPORARY AND CONDITIONAL <br />USE PERMITS AND ESTABLISHING GUIDELINES RELATED THERETO. <br />WHEREAS, upon review and recommendation ofthe Village's Planning and Zoning <br />Commission, it has been deemed in the best interest of the health, safety and welfare of all <br />the Village residents to amend Chapter 1149 of the Village's Codified Ordinances to more <br />specifically clarify temporary and conditional use permits and special use permits, when <br />and where their use is appropriate and the related guidelines to be used when reviewing <br />and determining the appropriateness of granting such permits. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Said Section 1149.02 of the Codified Ordinances is hereby and herein <br />amended to read as set forth in Exhibit "A" attached hereto and incorporated herein by <br />reference. The rest and remainder of Section 1149.02 shall remain in full force and effect <br />and all Village ordinances shall remain as presently drafted unless inconsistent with this <br />Ordinance. <br />SECTION 2. That the Clerk of Council is authorized and directed to forward a <br />certified copy of this Ordinance to the codifier of the Village for incorporation of the <br />amendments to Section 1149.02. <br />SECTION 3. That the guidelines set forth in Exhibit "B" attached hereto and <br />incorporated herein by reference, shall be adopted as the appropriate guidelines to be <br />used by the Village's Planning and Zoning Commission when reviewing applications for <br />Special Use Permits or Temporary and Conditional Use Permits. <br />SECTION 4. That the guidelines set forth in Exhibit "B" shall not be codified but <br />published, maintained and available from the Village's Building Department. <br />SECTION 5. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 6. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.
