ORDINANCE NO. 2006-16 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDIfVANCE AMENDING CHAPTER 1149 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE PERTAINING TO SPECIAL, TEMPORARY AND CONDITIONAL USE PERMITS AND ESTABLISHING GUIDELINES RELATED THERETO. WHEREAS, upon review and recommendation ofthe Village's Planning and Zoning Commission, it has been deemed in the best interest of the health, safety and welfare of all the Village residents to amend Chapter 1149 of the Village's Codified Ordinances to more specifically clarify temporary and conditional use permits and special use permits, when and where their use is appropriate and the related guidelines to be used when reviewing and determining the appropriateness of granting such permits. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Said Section 1149.02 of the Codified Ordinances is hereby and herein amended to read as set forth in Exhibit "A" attached hereto and incorporated herein by reference. The rest and remainder of Section 1149.02 shall remain in full force and effect and all Village ordinances shall remain as presently drafted unless inconsistent with this Ordinance. SECTION 2. That the Clerk of Council is authorized and directed to forward a certified copy of this Ordinance to the codifier of the Village for incorporation of the amendments to Section 1149.02. SECTION 3. That the guidelines set forth in Exhibit "B" attached hereto and incorporated herein by reference, shall be adopted as the appropriate guidelines to be used by the Village's Planning and Zoning Commission when reviewing applications for Special Use Permits or Temporary and Conditional Use Permits. SECTION 4. That the guidelines set forth in Exhibit "B" shall not be codified but published, maintained and available from the Village's Building Department. SECTION 5. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 6. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
