ORDINANCE NO. 2006-23 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE ACCEPTING S.O.M. COURT FOR <br />PUBLIC USE AND MAINTENANCE, AND OFFICIAL ASSIGNMENT OF <br />THE NAME S.O.M. COURT <br />PURSUANT TO CODIFIED ORDINANCE 1115.07(a). <br />WHEREAS, pursuant to Codified Ordinance 1115.07(a), a dedication plat has been <br />accepted by the Village; and <br />WHEREAS, an inspection of the street has been made by a committee of Council <br />and the Village Engineer and has not disclosed any defects BUT the Village Engineer has <br />requested that certain conditions be satisfied; and <br />WHEREAS, at this time Council wishes to accept S.O.M. Court as a Municipal street <br />for public use and maintenance subjection to the satisfaction of the conditions outlined by <br />the Village Engineer. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Based upon compliance by the developer with Codified Ordinance <br />1115.07(a), Council hereby and herein accepts S.O.M. Court as a Municipal street for <br />public use and maintenance by the Village, subject to the terms and conditions set for by <br />the Village Engineer, and authorizes the assignment of the name S.O.M. Court. All said <br />bonds shall be released thereafter the terms and conditions set forth by the Village <br />Engineer have been satisfied. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings o#this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Seetion 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.
